In short


1. About these terms

These are the Terms of Service for the Tides mobile application (“the service”, “Tides”), provided by Tiago Oliver Pinheiro Oliveira as a solo operator based in Spain (“we”, “us”, “our”). By using Tides, you (“you”, “your”) accept these terms.

If you do not accept these terms, do not use Tides. If you accepted these terms when signing up and later disagree with a change, your route is Delete account in Settings.

These terms are governed by the laws of Spain, subject to mandatory consumer-protection law in your country of residence. See Section 12.


2. What Tides is, and what it is not

Tides is a reflective journal for noticing how you feel and how the sky around you (weather, moon phase, astrological context) sits under those feelings. You write a short reflection; Tides keeps it; on quiet days, Tides offers a softly-phrased insight as one possible lens.

Tides is not:

If anything inside Tides ever reads as though it is telling you what to do, or what is going to happen, treat that as a writing failure on our part — not as advice. Write to tiopioli89@gmail.com and we will fix the wording.


3. Your account

To use Tides you sign in with Google Sign-In. By doing so you acknowledge that:

We do not charge for Tides in v1. If we introduce a paid tier later, we will tell you in the app and update these terms before any payment is asked of you.


4. The astrology disclaimer

Tides offers astrology as a reflective frame, not as a predictive system and not as a substitute for professional advice. This matters enough that it is its own section.

What this means in practice:

In short: Tides is a quiet room you bring a feeling into. It is not a voice telling you what to do.


5. Your content

Your journal entries — your descriptors, your reflections, your birth data, your location — are your content. You retain all rights to them. We do not claim ownership.

To run the service, we need a narrow licence from you. By using Tides, you grant us a limited, non-exclusive, revocable, royalty-free licence to store your content, transmit it between your device and our server, and display it back to you inside Tides, only for the purposes of operating the service for you.

This licence does not include:

We send the contents of your daily entry to OpenAI to generate the insight you see in the app. OpenAI’s API terms state that API inputs are not used to train its models; we rely on that policy. See the Privacy Policy, Section 6.4, for the full disclosure.


6. Acceptable use

Tides is a small, private tool. We ask you not to do the following:

If you do any of the above, we may suspend or terminate your access. See Section 9.


7. Availability

We provide Tides on a best-effort basis, free of charge. We do not guarantee uptime. We do not guarantee that any feature will remain available in any future version. We do not guarantee that the service will be free of bugs.

We will try to give you reasonable notice if we plan to discontinue the service. If we do discontinue it, you will have at least 30 days to export your data from Settings before account data is deleted.


8. Changes to these terms

We may change these terms over time. When we do, we will:

  1. Update the last updated date.
  2. Show a calm notice in the app the next time you open it, summarising what changed.
  3. Give you a reasonable window to delete your account if the change materially affects your rights.

Continued use of Tides after a change has taken effect means you accept the change. If you don’t accept, Delete account in Settings is your route out.


9. Termination

You can terminate at any time. Use Delete account in Settings. Your account is removed from our live database immediately; backups rotate out within 30 days. (See the Privacy Policy, Section 5.)

We can terminate or suspend your account if you breach these terms in a way that is not minor. Before we terminate, we will, except in clear-abuse cases:

  1. Tell you what we believe you have done.
  2. Give you a reasonable opportunity to fix it or to explain.
  3. Let you export your data before any termination becomes final.

We do not terminate accounts for inactivity. There is no streak. There is no expiry.


10. Eligibility and age

You must be at least 13 years old to use Tides. (See the Privacy Policy, Section 10, for the Spain-specific note on the 14-year LOPDGDD age and the corresponding open question.) If we learn that we have accepted a user below the minimum age, we will delete the account.

11. Disclaimers and limitation of liability

This section is the legally-required, less-friendly part. We have kept it as short as we can.

EU consumer-protection carve-out. Nothing in this section limits or excludes any right you have under the mandatory consumer-protection laws of your country of residence in the European Union or elsewhere. Where such laws give you rights that cannot be waived (for example under Spain’s Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios, the EU Sale of Goods and Digital Content Directive (EU) 2019/770 and 2019/771, or Brazil’s Código de Defesa do Consumidor for Brazilian users), those rights are not affected by these terms.


12. Governing law and disputes

These terms are governed by the laws of Spain, without regard to its conflict-of-laws principles.

If you are a consumer resident in the European Union or in the United Kingdom, you may bring proceedings in the courts of the country in which you reside; we may only bring proceedings against you in the courts of the country in which you reside. This is a mandatory consumer right and we are not asking you to waive it.

For all other users, the courts of Tiago Oliver Pinheiro Oliveira’s place of residence in Spain are the primary venue for any dispute, subject to any non-waivable rights in your country of residence.

The European Commission provides an Online Dispute Resolution platform at ec.europa.eu/consumers/odr which you may use to resolve disputes with us, although we will generally prefer to resolve them directly by email at tiopioli89@gmail.com.
